A West Point drummer filed a negligence lawsuit on Tuesday against Fox & Friends co-host Pete Hegseth, Fox News and various other defendants stemming back from a 2015 axe-throwing incident, The Washington Times reported Thursday.

Jeff Prosperie was performing in West Point’s Hellcats band when he was struck by an axe that Hegseth threw during a live taping of a segment for Fox & Friends in New York City. Hegseth was attempting to throw an axe at a target but overthrew, missing the mark and hitting Prosperie in the arm instead, according to The Washington Times.

Consequently, Prosperie suffered severe injuries leaving him with “permanent effects of pain, disability, disfigurement and loss of body function.” (RELATED: Black Lives Matter Activist Sues Fox News, Jeanine Pirro)

“The incident involving Jeff Prosperie from 2015 was unfortunate and completely unintentional. Fox News immediately apologized to Prosperie and offered medical assistance, which he declined saying he was ‘okay,’” Fox wrote in a statement. “The network also offered compensation, which he declined as well. We have not heard from Prosperie since 2015, so the lawsuit is surprising and we are reviewing it.”
