A Maryland county has disregarded an Immigration and Customs Enforcement (ICE) detainer request for an illegal immigrant suspected of child sex abuse, allowing for the individual to be released back into the community on bail.
The story: ICE agents submitted a detainer with the Montgomery County Detention Center for Guatemalan national Luis Fredy Hernandez-Morales who is staying in the U.S. illegally.
“JUST IN: @ICEgov tells me Montgomery County, Md. released an alleged child sex abuser on bond this week despite a pending immigration detainer. 48yo Luis Fredy Hernandez-Morales is accused of molesting an 11yo girl. Per ICE, the Guatemalan national is in the U.S. illegally,” tweeted ABC7’s Kevin Lewis on Friday morning.

A warrant for Hernandez-Morales’s arrest was released on Oct. 29 for allegedly inappropriately touching a minor on at least two separate occasions while at the victim’s Montgomery County home in July 2019, FOX5 reported.

In a statement to the Daily Caller on Friday, ICE acting Field Office Director for Baltimore Frank Madrigal criticized county officials for refusing to cooperate with the agency.
“The best way to serve public safety is to work together. Montgomery County had indicated they would securely transfer dangerous criminals to our custody rather than release them to the community where they can re-offend. These actions indicate they intend otherwise.”
Democratic Montgomery County Executive Marc Elrich has previously said that ICE agents will be allowed to arrest illegal immigrants in “identified areas,” but appears to have backtracked on that promise.
Luckily, however, ICE Enforcement and Removal Operations in Washington managed to arrest Hernandez-Morales on Friday.
