A federal appeals court on Friday upheld a judge’s decision to put on hold an Ohio law prohibiting doctors from performing abortions based on a fetal diagnosis of Down syndrome. The 2-1 ruling from a panel the 6th U.S. Circuit Court of Appeals in Cincinnati said the law signed in 2017 by former Republican Gov. John Kasich is likely unconstitutional but didn’t make such a declaration outright. The Ohio Attorney General’s Office said the state will seek reconsideration by the full 6th Circuit.
